Welcome to MySkin AI (the “App”). Please read these Terms of Use (“Terms”) carefully before using the App. These Terms constitute a legal agreement between you (“you” or “User”) and 42apps LLC, a company registered in Kazakhstan (“Company,” “we,” or “us”), regarding your access to and use of the App, our website https://myskinai.app, and related services (collectively, the “Services”).

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of the Service

MySkin AI is a mobile application that allows users to:

• Analyze their skin type and condition using face and skin scans.
• Analyze cosmetic products by scanning their labels and ingredients.
• Receive AI-based insights and recommendations on skincare and cosmetic compatibility based on data you voluntarily provide in a short questionnaire.

The App does not require account registration and does not store personal data, scans, or images on any external server. All image and text analysis is processed through OpenAI API, and data is deleted immediately after analysis.

2. Acceptance of Terms

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to these Terms. If you are using the App on behalf of another person or entity, you confirm that you have authority to bind that person or entity to these Terms.

We may update these Terms from time to time. When changes are made, we will post the revised Terms in the App or on our website. Continued use of the App after such changes constitutes your acceptance of the revised Terms.

3. No Medical Advice

The App and its features are for informational and self-assessment purposes only.

The App does not provide medical advice, diagnosis, or treatment.
The AI-based assessments are not a substitute for professional dermatological or medical consultation.

Always consult with a qualified healthcare provider or dermatologist for any medical concerns, skin conditions, or treatment decisions.

If you experience an adverse skin reaction, discontinue use of any products and seek medical advice immediately.

The Company is not responsible for any harm, damage, or loss resulting from the use of the App or reliance on its recommendations.

4. Privacy and Data Processing

We respect your privacy.

MySkin AI does not collect or permanently store personal information, photos, or skin data on our servers.

All image and ingredient analyses are processed securely through the OpenAI API, and data is automatically deleted after analysis.

By using the App, you agree that anonymized data may be temporarily transmitted for processing purposes only.

5. Subscriptions and Payments

The App offers auto-renewable subscriptions that provide access to premium features, including advanced AI analysis and personalized skincare insights.
Available plans include:

• Weekly Subscription
• Monthly Subscription
• Annual Subscription

Subscriptions are managed via your Apple App Store or Google Play account and will automatically renew unless canceled at least 24 hours before the end of the current period.

Payment will be charged to your App Store account at confirmation of purchase. Renewal charges will occur within 24 hours before the end of the current subscription period.

You can manage or cancel your subscription at any time in your device’s Account Settings.

Except where required by law, all payments are non-refundable and non-transferable.

6. Eligibility

The App is intended for users aged 13 or older (or 16+ for residents of the European Union).

By using the App, you confirm that you meet this age requirement.

If you are under this age, you may use the App only under the supervision and consent of a parent or legal guardian.

7. Use Restrictions

You agree not to:

• Reverse-engineer, decompile, or modify the App.
• Copy or distribute the App for commercial purposes.
• Upload harmful, illegal, or offensive material through the App.
• Attempt to bypass security or restrict others’ access to the App.
• Use the App to generate, share, or promote misleading or harmful health claims.

We reserve the right to suspend or terminate your access if you violate these Terms.

8. Third-Party Services

The App may include links or integrations with third-party services (such as OpenAI or Apple App Store).

We are not responsible for the content, privacy practices, or reliability of any third-party services.

Your use of those services is subject to their own terms and policies.

9. Disclaimer of Warranties

The App and all related content are provided “as is” and “as available”, without warranties of any kind, express or implied.

We do not guarantee that:

• The App will function uninterrupted or error-free.
• The information or recommendations provided will be accurate, complete, or suitable for your specific needs.

You use the App at your own risk.

To the fullest extent permitted by law, 42apps LLC disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, 42apps LLC, its directors, employees, or partners shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to skin reactions, health issues, or loss of data arising from your use of the App.

Our total liability to you shall not exceed the amount you paid for the App in the past 12 months, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless 42apps LLC and its affiliates from any claims, damages, or expenses arising from your misuse of the App, violation of these Terms, or infringement of any third-party rights.

12. Changes and Availability

We may update, modify, or discontinue any part of the App at any time without prior notice.

We are not liable for any loss caused by modification, suspension, or discontinuation of any features or services.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed under the laws of the Republic of Kazakhstan, without regard to conflict of law principles.

Any dispute arising under or in connection with these Terms shall be resolved by competent courts located in Almaty, Kazakhstan.
